Lighthizer will ‘absolutely’ continue to treat China as a non-market economy Lighthizer said he will “absolutely” continue to treat China as a non-market economy in trade remedy cases, despite China’s contention that doing so is in violation of World Trade Organization rules.
Lighthizer made the statement at his March 14 confirmation hearing. China informed WTO members on March 9 that it would move forward with a dispute against the European Union over China’s non-market economy status by requesting a panel, but made no mention of moving forward against the U.S. The EU and U.S. were named in China’s initial consultation request.
China believes that the December 2016 expiration of a provision in its accession protocol means members can no longer treat it as a non-market economy.
