Public domain에 속한 work들에 PD에 속해있으므로 안심하고 써도 된다는 표식을 붙이는 것은 좋은 아이디어이다. 꽤 오래 전부터 일반 사용자들은 마음놓고 쓸 수 있는 저작물을 표시해주는 무엇인가가 필요하다고 생각해 왔었다.

그래서 Creative Commons에서 그런 걸 만들고 있단다.

이 아이디어를 특허나 디자인에 적용해본다는 생각을 해본적이 있는데, 특허는 특허풀의 활동이 활발하고 특허풀이 어떨 때는 특허괴물같은 모양새를 가지기도 하는데, 그 경우는 특허풀들은 정확하게 PD에 속하는 특허가 분명하길 원하지 않는 경향도 있는 것 같아.

오픈소스 프로젝트에 여러가지 방식으로 기여하는 사람들(contributor)가 자신이 기여한 부분에 대한 권리의 조건들을 명확하게 할 필요가 있다.

대부분의 경우는 모든 권리를 오픈소스 프로젝트에 양도하거나 라이센스해주는 것이 바람직하겠지만, 그렇지 않은 경우라도 정확한 조건을 명시해주는 것이 바람직하다.

그런 이유에서 "Open Source Contributor License Agreements (CLA)"라는 건 중요하다.

Jarasum International Jazz Festival 2010

I liked the autumn breeze more than anything else about the festival.

I wish other festivals were held in September or October. Old schnubs like me can't stand the sizzling sunlight.

Salesforce.com, Microsoft, David Boies

Microsoft settled it patent infringement case with Salesforce.com (Aug. 4)
(see details here at ZDNet)

Microsoft complaint included Salesforce's alleged infringements of:

“method and system for mapping between logical data and physical data”
“system and method for providing and displaying a web page having an embedded menu”
“method and system for stacking toolbars in a computer display”
“automated web site creation using template driven generation of active server page applications”
“aggregation of system settings into objects”
“timing and velocity control for displaying graphical information”
“method and system for identifying and obtaining computer software from a remote computer”
“system and method for controlling access to data entities in a computer network”

Note 1: These are all method patents.

Note 2: David Boies represented Salesforce. He represented the Justice Department in the Microsoft antitrust case. He also represented Al Gore in Bush v. Gore.

Elena Kagan as new Supreme Court Justice

엘레나 케이건(Elena Kagan)이 112번째 연방대법관으로 상원의 confirmation을 받았다.

Note 1: 법관 경험이 없다.

Note 2: 하버드 법대 졸업. 현재 연방대법원은 아이비리그 출신들로만 구성되어 있다.

Note 3: Kagan이 추가되면서 trio of women justices가 완성된다. (Ginsburg, Sotomayor, Kagan)

Note 4: 이로서 9인의 justices는 John G. Roberts, Antonin Scalia, Anthony M. Kennedy, Clarence Thomas, Ruth Bader Ginsburg, Stephen G. Breyer, Samuel Anthony Alito, Jr., Sonya Sotomayor, Elena Kagan (to be nominated).
